1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Body by AI platform, website (bodybyaicoach.com), and mobile applications (collectively, the "Service"), operated by Body by AI Coaching LLC ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

Body by AI is an AI-powered fitness coaching platform that provides personalized workout programming, nutrition tracking, progress analysis, and coaching interactions. The Service uses artificial intelligence to generate recommendations based on your personal data, goals, and progress.

Important: Body by AI is not a certified personal trainer, licensed physical therapist, medical service, or any other fitness or healthcare professional. The Service provides fitness and nutrition guidance for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any exercise or nutrition program, especially if you have pre-existing health conditions.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • One account per person. Sharing accounts is not permitted

5. Subscriptions and Payments

5.1 Subscription Tiers

  • Standard ($29/month or $249/year): Unlimited AI coaching conversations, personalized workout programming, complete nutrition tracking, wearable integration, and progress analytics.
  • Pro ($59/month or $499/year): Everything in Standard, plus photo-based meal estimation, advanced body composition analysis, meal planning, grocery lists, recipe generation, and DEXA integration.

Both tiers include unlimited AI coaching conversations with no interaction caps or overage charges. We believe coaching works best when you never hesitate to ask a question.

5.2 Free Trial

All new users receive a 21-day free trial with full access to all features. No credit card required to start. Book buyers receive an extended 30-day free trial when they redeem their promo code at signup. Each copy of "Body by AI" contains a one-time promo code good for a 30-day trial with full Standard-tier access.

5.3 Billing

  • Subscriptions are billed monthly in advance via Stripe
  • All fees are in US dollars unless otherwise stated
  • You authorize us to charge your payment method on a recurring basis
  • Prices may change with 30 days' notice

5.4 Cancellation

  • You may cancel your subscription at any time from your account settings or Stripe billing portal
  • Cancellation takes effect at the end of your current billing period
  • No refunds for partial months
  • After cancellation, your data is retained indefinitely until you request deletion

5.5 Pricing Fairness

If we ever reduce our subscription prices, all existing subscribers automatically receive a prorated refund via Stripe for the difference between what they paid and the new lower price for the remainder of their current billing period. We believe in earning your business every month.

5.6 Refund Policy

  • 30-day satisfaction guarantee: If you are unsatisfied within your first 30 days as a paying subscriber, contact us for a full 30-day refund.
  • Monthly plans: No partial-month refunds after the first 30 days. Cancel anytime before renewal.
  • Annual plans: If you cancel an annual plan, you may request a prorated refund for unused full months remaining. Contact support@bodybyaicoach.com.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service
  • Share your account credentials with others
  • Upload malicious content, malware, or harmful code
  • Attempt to circumvent usage limits or billing
  • Impersonate another person or misrepresent your identity
  • Use the Service to provide competing fitness coaching services

7. Your Data

  • You own your data. All personal data, fitness data, nutrition logs, and progress photos you upload remain your property.
  • Data export: You can export all your data at any time in JSON and CSV formats.
  • Data deletion: You can delete your account and all associated data at any time.
  • License grant: By using the Service, you grant us a limited license to use your data solely for the purpose of providing the Service to you (e.g., processing by our AI coaching engine).

8. AI-Generated Content

  • The Service uses artificial intelligence to generate fitness and nutrition recommendations
  • AI-generated content is for informational purposes only and should not be treated as medical advice
  • AI recommendations may contain errors or inaccuracies. Always use your own judgment
  • We are not liable for injuries, health issues, or other damages arising from following AI-generated recommendations
  • If you experience pain, injury, or adverse health effects, stop following the recommendations and consult a healthcare provider

9. Health and Fitness Disclaimer

The Service is not a certified personal trainer, licensed physical therapist, medical device, or healthcare service. All workout programs, nutrition plans, and coaching interactions are for informational and educational purposes only.

  • Consult your physician before beginning any exercise or nutrition program
  • If you have a history of eating disorders, consult a mental health professional before using nutrition tracking features
  • The Service does not diagnose, treat, cure, or prevent any disease or medical condition
  • The Service does not guarantee any specific results. Individual results vary based on genetics, adherence, starting point, and other factors
  • Body fat estimations and body composition analyses are approximations, not medical measurements
  • If you are taking GLP-1 receptor agonist medications (e.g., semaglutide, tirzepatide), consult your healthcare provider before making changes to your exercise or nutrition regimen based on coaching recommendations
  • You use the Service at your own risk

10. Intellectual Property

The Service, including its design, code, algorithms, content, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

  • You may terminate your account at any time by deleting it from your account settings
  • We may suspend or terminate your account if you violate these Terms
  • Upon termination, your right to use the Service ceases immediately
  • Data deletion follows the timeline described in our Privacy Policy

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction located in Delaware.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.
